These Terms of Service (“Terms”) govern your access to and use of FlowDiff (the “Service”), provided by [Your Company Name] (“FlowDiff,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
FlowDiff is a web-based tool that captures full-page screenshots of two URLs you provide (typically a staging and a production version of the same web page) and generates a visual, pixel-level comparison highlighting the differences between them. The Service is offered on a subscription basis with a monthly comparison quota.
2. Accounts
You must register an account to use the Service. You agree to provide accurate information, keep your credentials secure, and promptly notify us of any unauthorized use of your account. You are responsible for all activity that occurs under your account.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.
3. Acceptable Use
You agree not to use the Service to:
- Capture or compare URLs you do not own or do not have permission to access. You are solely responsible for the URLs you submit and represent that you have the right to capture screenshots of them.
- Submit URLs that host illegal, infringing, defamatory, obscene, or otherwise unlawful content.
- Attempt to circumvent rate limits, comparison quotas, or access controls, or use the Service in a way that places excessive load on our infrastructure.
- Use the Service to harvest data from third-party websites in violation of those websites’ terms of service, robots directives, or applicable law.
- Reverse-engineer, decompile, or attempt to extract source code from any portion of the Service, except to the extent that this restriction is prohibited by applicable law.
- Resell, sublicense, or expose the Service as a public API without our prior written consent.
4. Subscriptions, Trials, and Billing
The Service is offered through paid subscription plans, each including a monthly comparison quota. New customers may receive a free trial of a fixed duration; if you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period and you will retain access until that date.
Payments are processed by Stripe, Inc. We do not store your full payment card details. By providing payment information, you authorize us and Stripe to charge the applicable fees, taxes, and any overage charges associated with your plan.
Except where required by law, fees are non-refundable. We may change pricing at any time; changes will not apply to the current billing period and we will provide reasonable advance notice before they take effect.
5. Your Content
When you submit URLs to the Service, FlowDiff loads those pages in a remote browser and stores the resulting screenshots, comparison metadata, and diff images on our infrastructure (see the Privacy Policy for details). You retain all rights in the content rendered on those pages and in the comparison results tied to your account.
You grant us a limited, non-exclusive, worldwide license to host, process, and display this content solely for the purpose of operating, supporting, and improving the Service for you.
6. Our Intellectual Property
The Service, including its software, design, branding, and all underlying technology, is owned by FlowDiff or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted by implication.
7. Third-Party Services
The Service relies on third-party providers, including (without limitation) Supabase for authentication and database storage, Cloudflare for image storage and content delivery, a third-party screenshot capture service for rendering remote pages, and Stripe for billing. Your use of the Service is also subject to those providers’ terms, and we are not responsible for their performance or availability.
8. Availability and Changes
We work to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. We may also limit, reduce, or terminate your access if we reasonably believe you have violated these Terms or are using the Service in a manner that risks harm to us, our users, or third parties.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account for material breach of these Terms or for any conduct that we reasonably determine to be unlawful or harmful. Upon termination, your right to access the Service ends and we may delete your stored data after a reasonable retention period, except where retention is required by law.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
FlowDiff compares the visual state of two URLs at the time the screenshots are captured. Differences in dynamic content, animations that loop indefinitely, A/B tests, third-party embeds, and time-sensitive content may produce false positives or negatives. The Service is a quality-assurance aid, not a substitute for human review or production deployment procedures. You are solely responsible for any decisions you make based on the comparison results.
11. Limitation of Liability
To the maximum extent permitted by law, FlowDiff and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.
Our total liability for any claim arising out of or related to these Terms or the Service is limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD $100), whichever is greater.
12. Indemnification
You agree to indemnify and hold FlowDiff harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
13. Governing Law and Disputes
These Terms are governed by the laws of [Jurisdiction], without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising from these Terms or the Service will be the state or federal courts located in [Venue], and you consent to personal jurisdiction in those courts.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting an updated version on this page and, where appropriate, by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
